Terms of use

The rules for using Lotaloja’s site and portal, and how proposals, contracts, payments and deliverables work.

About these terms

These terms cover the lotaloja.com website, the client area and the partner area, run by Lotaloja, based in Brasília, Brazil. The company’s full registration details are given in the contract.

By using the site or the portal, you agree to these terms. If there is a signed contract, the contract prevails wherever it differs. How we use personal data is explained in Data and privacy.

Using the website

The site, the articles and the Library are for information. They help you decide, but they do not replace a review of your case or legal, accounting or medical advice.

You may not use the site to try to break into systems, overload the server, send spam or copy the content to resell it.

Account and portal

  • You sign in to the portal with a Google account. The account is personal: do not share access.
  • You are responsible for what is done with your account. If you notice unusual access, use “Connected devices” to end sessions and tell the team.
  • Proposals, prices, checkups and materials in the portal are confidential. Each proposal opens only for the contact registered on it. Use this material only to review and follow the work for your business, and do not pass it on without permission.
  • Access to a proposal may have a deadline. We may suspend an account that misuses the portal.

Proposals and hiring us

  • Prices on the site are for reference, so you have an idea before we talk.
  • The price that applies is the one written in the proposal, together with its scope, deadlines and validity.
  • Ad budget, setup, tool licenses and WhatsApp messages are charged separately when the proposal says so.
  • You hire us by accepting the proposal and signing the contract.

Payment, late payment and cancellation

These are the general lines. Payment method, due dates, charges and exit rules are set in the contract.

  • Online payment through the site is not active yet. When it is turned on, these terms will be updated.
  • If a payment is late, the charges and grace period in the contract apply. If it stays late after notice, the service may be paused until payment.
  • One-off projects follow the payment and deliverables described in the proposal.

Why monthly plans have a 6-month minimum

The reason is technical. Google takes months to find, index and start trusting a site. Reviews on Google Maps build up slowly. Ads go through a learning phase before they settle. That is why the most solid results usually show up around 12 months, and less than 6 months is not enough time to measure.

During the plan, we review the course with you. After 6 months, you choose to continue or stop, with no penalty, giving notice as the contract provides. What has been done stays with you. Leaving before 6 months follows the terms of the contract.

Partners and referrals

  • Partners and referrers may introduce Lotaloja with a referral link or code. The referral is recorded so the right partner is paid for the introduction.
  • Commission and conduct rules for partners are in the partner agreement, separate from these terms.
  • A partner may not promise a price, deadline, discount or result different from the proposal, or sign on behalf of Lotaloja.
  • You can ask the team by email to correct or remove a referral.

Intellectual property

  • The Lotaloja brand, the site, its texts, methods, templates, internal tools and the code we use across clients belong to Lotaloja.
  • Once paid for, the material made for your business and listed in the proposal, such as texts, images, videos, pages and reports, is yours to use in your business.
  • Third-party licenses, such as fonts, stock images and paid tools, follow each provider’s rules.
  • What you give us, such as your logo, photos, texts and data, stays yours. You confirm you have the right to use it, and we use it only for the contracted service.

AI-made content

  • We use artificial intelligence to write, create images, videos and audio, and automate tasks. A person on the team reviews it before delivery.
  • AI-made content carries the label the platform or the law requires, such as the “made with AI” notice on social media.
  • A person’s voice or likeness is cloned only with their permission.
  • Anything published in your business’s name goes through your approval, as agreed in the contract.
  • We do not promise a Google ranking or a number of sales. Google does not allow paying for a better local ranking, and sales depend on many factors outside our control.

Limits of liability

We do the work with care and follow what the proposal says. Lotaloja is not liable for:

  • outages, rule changes or blocks by third-party platforms, such as Google, Meta, WhatsApp and hosting providers;
  • results that depend on the market, on your business’s customer service or on your own decisions;
  • decisions made only on the basis of the site’s informational content or the free checkup.

For contracted services, each party’s liability follows the contract. Nothing in these terms removes rights the law guarantees.

Consumer protection

When the client is a consumer, meaning they hire us for personal use and not for a business, such as someone who orders an app for their own routine, Brazil’s Consumer Protection Code (Law 8,078/1990) also applies.

When hiring online, a consumer may withdraw within 7 days of signing or of receiving the service, with a refund of what they paid (article 49).

Changes to these terms

We may update these terms. The date at the top shows the version in force. Changes do not alter contracts already signed, which follow what was agreed.

Governing law and venue

These terms are governed by Brazilian law. The chosen venue for any dispute is Brasília, Federal District, Brazil. If you are a consumer, you may file a claim where you live, as the Consumer Protection Code guarantees.
